If we process data as a data processor on behalf of our customers (e.g., for accessibility compliance reports), the customer’s privacy notice and our data processing agreement apply.

We collect personal data to deliver inclusive, accessible solutions that empower users. The data we collect depends on how you engage with our Services:
- Account and Profile Data: When you sign up for an account, trial, or training session, we collect your name, email address, organization, job title, and contact details.
- Usage Data: Information about your interactions with our website, platform, or apps, including IP address, browser type, device details, pages visited, and actions taken (e.g., audit requests or dashboard activity).
- Service Data: Data you or your organization submits through our Services, such as accessibility compliance reports, PDF remediation inputs, or feedback. As a processor, we handle this data per our customers’ instructions.
- Training and Event Data: Information provided when registering for workshops, webinars, or consultations, such as contact details or accessibility training preferences.
- Marketing Data: Details you share when subscribing to newsletters or engaging with our campaigns, like email preferences or interests.
- Payment Data: Billing details (e.g., credit card or payment account information) processed securely via third-party providers for subscriptions or services like audits.
- Other Data: Feedback, survey responses, or inquiries sent to support@accesstive.com, including accessibility statement requests or legal support queries.
We may also collect data automatically via cookies (see Section 8) or from third parties, such as analytics tools or integration partners. (such as Google Analytics & Zoho)
2. How Does Accesstive Use Your Personal Data?
We use your data to make digital experiences accessible and seamless, aligning with our mission to prioritize inclusion. Specific uses include:
- Delivering Services: Managing accounts, providing accessibility audits (manual and automated WCAG testing), continuous monitoring, PDF remediation, and integration with platforms like WordPress, TYPO3, or Shopify.
- Enhancing Accessibility: Analyzing usage to improve our platform, dashboards, and alerts, ensuring compliance with standards like WCAG 2.1 AA, ADA, and EN 301 549.
- Supporting Customers: Offering training workshops, developer consultations, and legal support (e.g., accessibility statement generation or lawsuit response assistance).
- Communication: Sending service updates, responding to inquiries, or sharing newsletters and promotions (with consent, where required).
- Compliance and Security: Meeting legal obligations (e.g., ADA, AODA, BFSG) and protecting our Services from fraud or misuse.
- Personalization: Tailoring dashboards, reports, or training content to your needs, ensuring high-contrast, readable outputs.
As a processor, we use customer-submitted Service Data only as directed by our customers (the data controllers).
3. What Legal Basis Do We Rely On?
We process personal data in compliance with global privacy laws, including GDPR (EU), CCPA (USA), AODA (Canada), RPwD Act (India), Equality Act 2010 (UK), and Germany’s BFSG. Our legal bases are:
- Contractual Necessity: To deliver Services under our Terms of Service, such as providing audits, monitoring, or integrations.
- Consent: For optional activities like marketing emails, training registrations, or non-essential cookies (you can withdraw consent anytime). We provide opt-out options via email or direct communication from our platform.
- Legitimate Interests: To improve our platform, analyze usage, or prevent fraud, provided your rights are not overridden.
- Legal Obligations: To comply with regulations, such as providing VPAT reports (USA), accessibility statements (EU), or feedback mechanisms (Canada).
For EEA/Switzerland customers, we act as a controller for account and marketing data and as a processor for Service Data. Customers acting as controllers must ensure their own compliance.
4. How Do We Share Your Personal Data?
We share personal data only with trusted partners to deliver our accessibility-focused Services, under strict agreements:
- Affiliates: Accesstive group companies supporting audits, training, or technical operations.
- Sub-Processors: Third-party providers (e.g., cloud hosting, analytics, payment processors) assisting with our Services. See our sub-processor list at [www.accesstive.com/sub-processors].
- Integration Partners: Platforms like WordPress, Shopify, or TYPO3 for seamless Service integration, per customer instructions.
- Business Transfers: In cases of mergers, acquisitions, or reorganizations, we may share data with relevant parties, with efforts to notify you.
- Legal Requirements: When required by law, such as for regulatory compliance (e.g., ADA, BFSG) or court orders.
We never sell or rent your data. All sharing complies with applicable laws and our commitment to inclusion.
5. Where Do We Process and Store Your Data?
All your data is securely stored and processed in Germany by our trusted partner, ALL-INKL.COM (Neue Medien Münnich, Hauptstraße 68, 02742 Friedersdorf, Germany).
Their state-of-the-art data centers are ISO-certified and comply with GDPR, Germany’s Barrierefreiheitsstärkungsgesetz (BFSG, by mid-2025), and EN 301 549 requirements. With daily full backups and robust security measures, your data stays safe and accessible within Germany’s strict data protection framework. 6. Your Rights and Choices
We empower you to control your personal data, in line with global laws (e.g., GDPR, CCPA, AODA). Your rights include:
- Access: Request a copy of your data, including VPAT reports or accessibility statements.
- Correction: Update inaccurate data.
- Deletion: Request data deletion, where permitted.
- Restriction: Limit processing in certain cases.
- Data Portability: Receive your data in a structured format.
- Objection: Opt out of marketing or processing based on legitimate interests.
- Withdraw Consent: Stop marketing or non-essential cookies anytime.
